Terms and Conditions

Last Updated: September 2026

By engaging The Redland Landscaper (ABN: 80 273 675 403), you agree to the following terms and conditions:

1. Scope of Work & Variations

● Scope: We will complete the landscape construction work (including timber retaining walls, paving, turf laying, and site preparation) as specified in your written quote or contract.

● Variations: Any additions, changes, or extra site work requested by the client after acceptance of the quote will be treated as a variation and quoted separately before work proceeds.

2. Council Approvals & Site Boundaries

● Building Approvals & Certifications: Timber retaining walls over a specific height (typically 1 metre, subject to local council rules) or near property boundaries/structures may require engineering certification and council approval. Unless explicitly included in our quote, obtaining approvals and paying associated fees is the client's responsibility.

● Property Boundaries: The client is responsible for identifying exact property boundary lines. We accept no responsibility for structures placed according to boundary points incorrectly indicated by the client.

3. Underground Services & Site Conditions

● Underground Hazards: Clients must notify us in writing of all underground services (including irrigation, gas, water, electrical, stormwater, septic tanks, and telecommunications cables) prior to excavation.

● Unforeseen Site Conditions: Quotes are based on standard soil excavation. Additional costs may apply if we encounter unexpected subterranean obstacles such as hard rock, hidden concrete footings, high groundwater, or buried waste that requires specialised heavy machinery or extra haulage.

4. Materials, Site Access & Delivery

● Site Access: Clients must provide clear and unobstructed access to the site for earthmoving machinery, Bobcats, trucks, and materials delivery on agreed work days.

● Material Placement: Heavy materials (timber, sand, soil, pavers) will be placed as close to the work area as safely possible. We accept no liability for minor surface marks or wheel ruts on driveways or lawns caused by standard material delivery vehicles.

5. Turf & Plant Care Post-Installation

● Turf & Living Materials: Once turf, plants, or organic soil are installed on site, full responsibility for ongoing care (including immediate and regular watering, fertilising, and pest control) transfers to the client. We do not offer warranties on turf or plants that fail due to underwatering, extreme weather, or lack of ongoing maintenance after handoff.

6. Weather Delays

Landscape construction relies heavily on dry soil conditions for earthworks, concrete footings, and paving bases. We reserve the right to delay or reschedule site works due to persistent rain, waterlogged ground, or extreme heat to ensure structural integrity and site safety.

7. Payment Terms & Progress Payments

● Deposits: A deposit (as agreed upon in writing and in accordance with relevant state building regulations) is required prior to ordering materials and locking in start dates.

● Progress Invoices: For multi-stage projects, progress invoices will be issued at key project milestones. Final payment is strictly due within 7 days of project completion via direct bank transfer or credit card.

● Ownership of Materials: All materials supplied remain the property of The Redland Landscaper until paid for in full.

8. Cancellations

Cancellations made after material orders have been placed or within 48 hours of scheduled site commencement may incur restocking fees, delivery cancellation charges, or loss of deposit.

9. Insurance & Warranty

The Redland Landscaper holds current Public Liability Insurance. Workmanship on structural elements (such as timber retaining walls and paved surfaces) is covered under applicable statutory trade warranties, provided structures have not been modified, overloaded, or damaged by third parties
